What If?: Insurance and The Law of Attraction ? Just Wondering ...

I don?t have insurance. Of any kind whatsoever. No medical insurance, no householders insurance, no life insurance, no death insurance, no social insurance? nothing. I haven?t had any since 1997 and arrogantly adopted the meme of my then partner: ?I don?t insure anything I cannot afford to lose.? And yes, we had money?lots of it.

We had a few houses, a farm, boats, many cars, several aircraft and a lodge next to the sea. We travelled a lot, sailed and dived and flew. Things broke, got stolen, sank and crashed and were replaced and repaired or not. We got ill, sometimes hospitalized, tested, tweaked and put back together again in some semblance of working order. Our lifestyle attracted, and it wasn?t the good stuff.

During the almost three decades of my first marriage, we had all the insurances that life expected?medical, house owner?s, householder?s, life, death, old age, car?you name it, we had it. What we had, we insured. And we got ill, we lost, broke, had stolen, filled in the forms, argued the points, dealt with assessors, squirmed at the settlement figures?but that is what life expected, not so? Not only expected?it was demanded? by law!

Then, almost nine years into a troubled relationship, the day came that I had to make a choice: Stay with the money and most probably lose my life through means foul, or walk away from it all and learn to live again. I walked away.

I had made a small investment that would earn interest for my lifetime allowing me to live without concern?IF I made the correct choices.

For a year, I disappeared. No one knew where I was?not my friends, not my children or any of my family? ?The Lam? would describe it well. It was a year of re-evaluating: What are my needs, my wants? Making lists titled ?Keep? and ?Lose.?

But first there was the list titled ?Find? and it had only one item, ?me.? I had to find me?the me I had misplaced. The me who believed we are created perfect, we have immense ability to heal ourselves and others; we can do anything if we put our minds to it; we were put on this planet to explore and learn and do good things for our fellow man; the power of our intent moves things to and away from us?the choice is ours.

And so, for a year without family, old friends or medical relief and with only the clothes on my back and other minimal stuff (my computer and camera are necessities!), I rented a house next to the sea and spent the days confronting some extremely aggressive opponents: Anger, pain, sorrow, bitterness, shock, horror, loss, drug and alcohol abuse?were faced alone. There was no other way, as only I could fix me?not all the medication, consultation, counselling, booze or drugs?only me.

I meditated, walked the beach, climbed rocks, wrote poetry and music and even started writing a book about my life which I deleted after page 220. It was a hard year, a wonderful year and I emerged from a cocoon battered but with an astounding inner beauty. Wings torn and ragged, light bright.

The lists were easy once everything was in the correct order: Find ? me; Lose ? stuff; Keep ? me. And me includes my health and what I need to get where I am going and do what I must do, which is again, only me.

And I made a deal with the Universe: You look after me and I will look after you.

Aged 54, I set out on a journey across the world with a suitcase, backpack, laptop and camera. I have kept flying to the minimum as I don?t like airports and, except for take-off and landing, flying is beyond boring. I travel by road?bus, minibus, foot. I sometimes put my head on pillows that have to be beaten into submission to stop them crawling away.

Into less than seven years I squashed many countries for anything up to two years: India, Thailand, Mexico, Laos, Uganda, Cambodia, Switzerland, South Africa, New Zealand, Singapore, Malaysia, Canada, U.S., Philippines, Kenya, Malawi and Greece.

I?ve had my ?fright nights? with close calls on things like air disasters, tuk-tuk crashes, diving miscalculations, malaria (many times), luggage going astray (always returned intact), computer failure, forgetting where I put things and leaving them behind? little irritations and a few big scares.

But no insurance?nothing.

Do I take care of my health? If that means drinking bottled water, washing fruit and vegetables before eating, covering my face with a protective mask against dust and fumes, washing my hands every time I touch something questionable, using antibacterial unguents, having flu shots and vaccinations, having meals only from trusted restaurants, buying food from stores?good lord, no.

I drink the water on tap, eat from street vendors, buy fruit in markets and eat it on the way home, walk cities filled with all manner of fumes and smog, and tramp dusty roads that throttle the breath from trees. Clothes are shopped for in markets?preferably secondhand. I get cuts and bruises and even broke a bone in my foot. I hug beggars, cradle HIV/AIDS infected babies, touch the sick, repair the wounded? without surgical gloves!

Nature thought of everything. We have hair in our noses and ears and around our eyes to trap dust and harmful particles; the capillaries of our hearts, lungs and other organs (never forgetting the skin is our largest organ) adapt to all sorts of circumstances if we give them the time to do so. Our bodies have mechanisms to cope with all manner of bacteria and germs, strengthening our immune systems. When last have I had a scan or smear or examination? Is it 10 years now?

?But, what if something is wrong, wouldn?t you want to know so it can be caught in time??

?Nothing is wrong.?

?How can you say that? Are you a doctor??

?Because I know and yes, I am my own doctor.?

I have had malaria (recurring) more times than I care to think about?the last time almost two years ago. My health is my gauge of the road I am walking. If I have taken a wrong turn, my health suffers and all manner of lurgy attach themselves. Then I put the universe on notice that I intend moving back to the correct path when I heal. I heal.

Computers and cameras break and I repair or replace them. Fortunately this hasn?t been often. The only time I misplace things is when my thoughts are scattered?note to self: unscatter yourself.

Recently, under pressure (you are not getting any younger, you know) from an acquaintance, I looked into getting health insurance. It felt wrong. I saw him get sick, or have something bother him and even with insurance (Medicare/Medicaid?the difference still confuses me) he wouldn?t go to a doctor as it wouldn?t be covered. I saw things break that couldn?t get fixed as the excess payable under the cover, was more than the repair. Everything he had was owned by the insurers: House, cars, health, disability, death, travel.

Insurance supposedly covers the ?what if.? What if I get sick, what if I have an accident, what if I lose something, what if something gets stolen?

What if you/it doesn?t?

The Law of Attraction is a powerful law, but it works both ways. To pay ridiculous amounts of money to insure against ?what if? attracts exactly that. It changes a mindset from ?I will not lose; I will not get sick, I will only walk in light and abundance? to ?it?s OK if I get sick and lose things, break things. I pay insurers to cover that. As long as I pay my premiums, have my annual check-ups, I am covered.?

And with that mentality, we move exactly those things to us and at great cost. We are surprised when insurers point us to the clause written in fine print that absolves them of the need to pay.

I refuse to fall into the same pit. To insure against ?what if?? beckons it. Many times I have been asked:

?What if you get sick or have an accident??

?I won?t.?

?How do you know that??

?Because I said so.?

?What if you get old and frail and need to be put in a hospice to die gracefully??

?I won?t. I will never get old, I will never get sick, I will never die. When it is my time to leave this planet, I will simply disappear?Poof! And I will be gone.?

?Do you mean to say that you can think yourself well??

Yes, that is exactly what I mean. Think yourself well, think yourself whole, think yourself cared for, think yourself a being of perfection with the ability to heal, mend and walk with courage. Think of yourself in abundance.

What if your umbrella was a more stable law and, on jumping, you flew?

    COLUMBUS, Ohio - The No. 14 Ohio State women's volleyball team heads to the University of Kentucky for the opening round of the 2012 NCAA Division I Women's Volleyball Tournament and takes on Notre Dame Friday at 5 p.m. ET in Memorial Coliseum.

    This year's selection marks the fourth-consecutive year the Buckeyes have reached the NCAA Tournament. Ohio State holds a 28-18 record in 18 appearances. Last season, the Buckeyes defeated Middle Tennessee State in the first round and followed with a 3-2 victory over host Tennessee to make their second-straight Sweet 16 appearance.     The 2012 senior class of Mariah Booth, Emily Danks, Mari Hole and Amanda Peterson have been an instrumental part in the program's success over the last four years. Booth, Danks and Peterson were all a part of head coach Geoff Carlston's first recruiting class with Hole joining the squad last season.
    ??????????????? The quartet has been leaders in their respective positions on the court this season for the Buckeyes. Hole and Danks are the team's key offensive performers with Booth leading the blocking corps. Peterson has paced the Buckeye offense and is among the Big Ten's best in assists. All four will conclude their careers in the Top 20 on a handful of Ohio State career lists.?

    B1G HONORS
    Seniors Mari Hole and Emily Danks and junior Kaitlyn Leary earned All-Big Ten honors, the league announced Tuesday. Hole was one of eight voted as a unanimous All-Big Ten selection, while Danks and Leary earned All-Big Ten honorable mention.
    ??????????????? Hole picked up her second All-Big Ten honor after leading the squad with a 4.36 kills per set average against conference opponents. That mark was second among all Big Ten student-athletes. The outside hitter from Oslo, Norway, was fourth in the league with an average of 4.74 points per set. Hole garnered two Big Ten Player of the Week nods this season and also was named the Sports Imports/AVCA National Player of the Week in mid-November. Overall, she totaled 31 double-digit kill matches with 17 double-doubles (kills/digs) to lead the Buckeyes.
    ?????????????The All-Big Ten honorable mention honor is the second-consecutive honor for Danks. The opposite was among the league's best in aces, totaling 29 against Big Ten opponents for a .38 average. The Round Rock, Texas, product finished with a 2.16 kills average and led the team with 62 blocks in conference play. Danks had 16 double-digit kill performances overall, including two double-doubles during the Big Ten season.
    ???????????? Leary earned the first Big Ten honor of her career after having a breakout season for Ohio State. The Parma, Ohio, product finished second on the squad with a 3.20 kills average against league foes, totaling 243 on the year. The outside hitter also finished second in points, average 3.42 per set. Leary totaled 18 double-digit kill matches this season, including 15 against Big Ten competition.?

    MILESTONES REACHED
    Seniors Mari Hole and Emily Danks each reached major milestones in their final season with Ohio State.
    ??????????????? Hole has had two outstanding seasons with Ohio State, leading the Buckeye offense both this season and last. The Oslo, Norway, product, who transferred from UCLA last year, became the 20th Buckeye to record 1,000 kills in a career Saturday vs. Indiana. Her road to 1,000 was the third-fastest in program history behind former Buckeyes Vanessa Wouters (1996-97) and Stacey Gordon (2001-04). She finished the weekend with 1,046 career kills.
    ??????????????? Danks has consistently been one of the top servers in the Big Ten and had been making her way up the Ohio State career service aces list. She entered the season with 180, needing 28 to break Lisa Bettio's record of 207 set in 1985. Danks picked up the record-tying ace in the middle of set two against Northwestern (10/6) and broke the record in the same set to give the Buckeyes a 25-23 victory. She enters the weekend with 227 overall.
    ??????????????? Danks also notched her 1,000th kill this season, coming against Toledo (8/25). She currently sits 12th in Ohio State history with 1,299 kills in a four-year span.?

    ANOTHER 20-WIN SEASON
    With its 3-2 win over Illinois (11/10), Ohio State notched its fourth-straight season with 20 or more wins under head coach Geoff Carlston and the 27th season with 20+ wins in the program's 42-year history.?

    CARLSTON'S 100TH WIN
    In his fifth year at Ohio State, head coach Geoff Carlston reached a milestone in his career with the Buckeyes on Nov. 2 in the team's 3-1 win over Wisconsin. Carlston became the third coach in program history to reach 100 wins at Ohio State. While with Ohio State, he has guided the Buckeyes to four-straight 20 win seasons and has led the team to three NCAA tournaments, including back-to-back NCAA Sweet 16 appearances.
    ??????????????? Carlston also needs three more wins for 300 in his 13-year coaching career. Carlston is 104-67 at Ohio State and 297-131 in his career.?

    ROAD WARRIORS
    The Buckeyes seem to love the challenge of playing on the road as the squad is 11-2 this season when competing away from St. John Arena, including an 8-2 record in Big Ten road matches. The team's losses this year came at the hands of then-No. 10 Minnesota (Sept. 28) in three sets and most recently, at No. 1 Penn State (11/21).?

    SCOUTING NOTRE DAME
    The Fighting Irish finished their regular season 20-9 overall and 13-2 in the Big East. The squad is on a three-match losing streak, including a 3-2 loss against Ohio last weekend. Notre Dame finished third overall in the Big East and it is the first NCAA appearance for the Fighting Irish since 2009.
    ???????????Sophomore Toni Alugbue has a 3.50 kill average and 4.07 points per set average, while sophomore Jeni Houser is second on the squad with a 3.27 kill average. Junior Maggie Brindock has an assist average of 9.66 and freshman Taylor Morey is averaging 4.18 digs per set.?
    ?????????? The Buckeyes hold a slight 4-3 lead over the Fighting Irish and their last match up was in 1996 in the NCAA tournament with Ohio State taking a 3-2 win.?

    SCOUTING EAST TENNESSEE STATE
    East Tennessee State earned the program's first bid to the NCAA tournament after the squad captured its first ever Atlantic Sun Tournament title with a 3-2 win over North Florida (11/17). The Bucs enter the weekend with a 23-12 overall record.
    ??????????????? Junior Megan Devine was recently named the A-Sun Player of the Year and averages 3.96 kills per set. Sophomore Meredith Hardy garnered A-Sun First Team honors and is second on the squad with a 2.85 kill average. Hardy leads the Bucs with a 1.46 block average. Freshman Khadijah Wiley earned a spot on the All-Freshman team and closed out the regular season with a .99 block average.

    The Kentucky Wildcats enter the tournament with a 20-10 overall mark. The team finished third in the SEC East at 14-6 and fourth overall. UK closed out the regular season last weekend with a pair of 3-0 wins over Missouri and Auburn.
    ??????????????? Senior libero was named the SEC Libero of The Year for the third-consecutive season. She averaged 4.09 digs per set in conference play and finished with a 3.91 overall average. Junior Whitney Billings was named to the first team and leads the squad with a 3.03 kill average. Freshman Sara Schwarzwalder was an All-Freshman team pick and totaled 85 blocks for a .89 average.
    ??????????????? Ohio State holds a slight 6-4 advantage of over the Wildcats. The two teams last met in early 2010 with Kentucky taking a 3-1 victory.?

    BIG TEN STANDINGS
    Ohio State finished the regular season fourth in the Big Ten with a 13-7 overall record. Penn State captured the Big Ten title with a 19-1 mark, while Nebraska and Minnesota finished tied for second at 15-5. Purdue rounded out the top 5 with a 12-8 record.

    Syria "firing mortars to stop refugees:" U.N. aid chief

    ZAATARI, Jordan (Reuters) - The United Nations humanitarian chief accused Syria on Tuesday of firing mortar bombs near the border with Jordan to prevent refugees from fleeing a civil war that she says is "getting worse day by day".

    In an interview with Reuters at the Jordanian refugee camp of Zaatari on Tuesday, Valerie Amos said that during a visit to the border the night before she was able to see "what was definitely mortar fire on the Syrian side of the border to try to prevent people from crossing."

    Opposition activists say 40,000 people have been killed in the revolt against the rule of Bashar al-Assad, which started out as peaceful protests 20 months ago only to descend into full civil war.

    Almost half a million refugees have fled into Turkey, Lebanon, Jordan and Iraq as the fighting has spread and more are expected as winter approaches.

    "We need the agreement by all those involved in the conflict to ensure they will not in any way bomb or shell or fight (refugees)," Amos said.

    30,000 people live in the windswept Zaatari camp - half of them children - and some tents are being replaced with 2,000 more permanent prefabricated homes. In the months since Zaatari opened it has come to resemble a shanty town with small vendors now selling fresh vegetables and second-hand clothes.

    Amos talked to refugees, some of whom complained they had few blankets at the start of the biting winter cold and were not getting enough food.

    "You can see the anger, fear and resentment. There is considerable trauma here," Amos said during her visit.

    50 PERCENT FUNDED

    World powers are divided over the crisis and have been unable so far to agree on action to halt the violence, with Assad's allies Russia and China having vetoed three United Nations Security Council resolutions.

    "We will do all we can to help the refugees and people of Syria but this requires the international community to work together to find a political solution which meets the needs of the Syrian people," Amos said.

    She said that a U.N. appeal for Syria's 2.5 million internally displaced people has only been 50 percent funded, and that the world body was planning for numbers of up to 4 million.

    "Given the intensification of the violence inside Syria I am sure they will go up in the next few weeks," she added.

    Amos said that through partner bodies including the World Food Programme and the Syrian Arab Red Crescent, food is being supplied to 1.5 million people. But that the United Nations need more partner organization to reach the displaced.

    "We would like to be able to increase that to 2.5 million people but we do not have the capacity through the partners we are able to use," she said.

    Aid organizations in Syria have complained of severe government restrictions on movement and Amos said that over 50 percent of healthcare facilities had been damaged during the conflict.

    "I am extremely worried about it, the situation is getting worse and it's ordinary people who are bearing the brunt of this violence and we are appealing to the international community to support the Syrian people and to find a resolution to this as soon as possible."

    Egypt's Mursi to meet judges over power grab

    CAIRO (Reuters) - Egyptian President Mohamed Mursi meets senior judges on Monday to try to defuse a crisis over his seizure of new powers which has set off violent protests reminiscent of the revolution last year that led to the rise of his Islamist movement.

    The justice minister said he believed Mursi would agree with the country's highest judicial authority on its proposal to limit the scope of the new powers.

    But the protesters, some camped in Cairo's Tahrir Square, have said only retracting the decree will satisfy them, a sign of the deep rift between Islamists and their opponents that is destabilising Egypt two years after Hosni Mubarak was ousted.

    "There is no use amending the decree," said Tarek Ahmed, 26, a protester who stayed the night in Tahrir, where tents covered the central traffic circle. "It must be scrapped."

    One person has been killed and about 370 injured in clashes between police and protesters since Mursi issued the decree on Thursday shielding his decisions from judicial review, emboldened by international plaudits for brokering an end to eight days of violence between Israel and Hamas.

    The stock market is down more than 7 percent.

    Mursi's political opponents have accused him of behaving like a dictator and the West has voiced its concern, worried by more turbulence in a country that has a peace treaty with Israel and lies at the heart of the Arab Spring.

    Mursi's administration has defended his decree as an effort to speed up reforms and complete a democratic transformation. Leftists, liberals, socialists and others say it has exposed the autocratic impulses of a man once jailed by Mubarak.

    Mursi's office said he would meet Egypt's highest judicial authority, the Supreme Judicial Council, on Monday, and the council hinted at compromise.

    Mursi's decree should apply only to "sovereign matters", it said, suggesting it did not reject the declaration outright, and called on judges and prosecutors, some of whom began a strike on Sunday, to return to work.

    Justice Minister Ahmed Mekky, speaking about the council statement, said: "I believe President Mohamed Mursi wants that."

    LIBERALS ANGRY

    The protesters are worried that Mursi's Muslim Brotherhood aims to dominate the post-Mubarak era after winning the first democratic parliamentary and presidential elections this year.

    A deal with a judiciary dominated by Mubarak-era judges, which Mursi has pledged to reform, may not placate them.

    A group of lawyers and activists have also challenged Mursi's decree in an administrative court, which said it would hold its first hearing on December 4. Other decisions by Mursi have faced similar legal challenges brought to court by opponents.

    Banners in Tahrir called for dissolving the assembly drawing up a constitution, an Islamist-dominated body Mursi made immune from legal challenge. Many liberals and others have walked out of the assembly saying their voices were not being heard.

    Only once a constitution is written can a new parliamentary election be held. Until then, legislative and executive power remains in Mursi's hands, and Thursday's decree puts his decisions above judicial oversight.

    One Muslim Brotherhood member was killed and 60 people were hurt on Sunday in an attack on the main office of the Brotherhood in the Egyptian Nile Delta town of Damanhour, the website of the Brotherhood's Freedom and Justice Party said.

    The party's offices have also been attacked in other cities.

    One politician said the scale of the crisis could push opponents towards a deal to avoid a further escalation. Mursi's opponents have called for a big demonstration on Tuesday.

    "I am very cautiously optimistic because the consequences are quite, quite serious, the most serious they have been since the revolution," said Mona Makram Ebeid, former member of parliament and prominent figure in Egyptian politics.

    Mursi's office repeated assurances that the steps would be temporary, and said he wanted dialogue with political groups to find "common ground" over what should go into the constitution.

    Talks with Mursi have been rejected by members of a National Salvation Front, a new opposition coalition that brings together liberal, leftist and other politicians and parties, who until Mursi's decree had been a fractious bunch struggling to unite.

    MILITARY STAYING OUT

    "There is no room for dialogue when a dictator imposes the most oppressive, abhorrent measures and then says 'let us split the difference'," prominent opposition leader and Mohamed ElBaradei said on Saturday. He has said he expected to act as the Front's coordinator.

    The military has stayed out of the crisis after leading Egypt through a messy 16-month transition to a presidential election in June. Analysts say Mursi neutralised the army when he sacked top generals in August, appointing a new generation who now owe their advancement to the Islamist president.

    Though the military still wields influence through business interests and a security role, it is out of frontline politics.

    Egypt had hoped to stop the economic rot by signing an initial deal last week for a $4.8 billion loan from the International Monetary Fund. As well as tumbling share prices, yields at a Sunday treasury bill auction rose, putting even more pressure on the government that faces a crushing budget deficit.

    "We are back to square one, politically, socially," said Mohamed Radwan of Pharos Securities, an Egyptian brokerage firm.

    Romantic Proposal: Reddit User Hangs 100 LED Lights From Tree (PHOTOS)

    Marriage proposals don't get much more romantic than this, folks.

    On Monday, Reddit user thekidd142 posted photos of his LED-lit marriage proposal to his girlfriend, knitnotpurl, in a thread titled, "Last week I proposed to my girlfriend of 3 years and this is how I did it. I had to wait for her to stop crying before I could even ask her to marry me."

    Thekidd142 wrote that he and a few friends spent four to five hours cutting wire and attaching it to more than 100 mason jars. The day of the proposal, they went to knitnotpurl's family farm and spent another five hours placing LED lights inside the jars and hanging them from her favorite tree.

    "We had to turn them on as we hung them so I was a little worried that the tree would burn down or that they would be out of battery by the time my girlfriend and I drove back out. But things as they were, we got there after sunset and it was more beautiful than I had even expected it to be," thekidd142 wrote.

    Knitnotpurl said "yes," and wrote that she was surprised about the tree, but not the proposal.

    "To be honest he's not really a romantic guy...or I thought he wasn't," she wrote. "He has obviously proven he can be very romantic. All the more reason to say yes!"

    Guest Blog: Giving Leasing Proper Credit ? Ideas and Information ...

    don-vance-135x180Leasing has long been recognized as a smart financial option that can help to maximize cash flow while minimizing investment outlays. ?And indeed, more companies are now acquiring new equipment through leases than through bank loans, according to the Association for Equipment Leasing and Finance. ?Over the last ten years, use of leasing finance options in the U.S. has tripled-and while there was a slowdown in leasing activity in the past two years, a recent lease market study predicted that in 2008, because of tightening credit and cash-flow squeezes, growth in this option will be seen again.

    Resorts and clubs are very much a part of this trend, with 73% of properties now reporting in industry surveys that they do some leasing, both in their staff offices (for copiers, computers, phone systems, postage meters, etc.) and elsewhere on their properties (for course maintenance equipment, kitchen equipment, furniture, etc.). ?The top three reasons cited by clubs and resorts for leasing instead of buying are: 1) to have a better ability to manage their property?s growth; 2) to take advantage of the latest technology; and 3) to improve asset management.

    Leasing can be an especially good idea for minimizing initial cash investments when starting up a new club; as a manager who?s been involved in several property start-ups myself, I can personally attest to how they were a huge help in getting us up and running and through those first years. ?But I?ve also seen how too many start-up properties can get in over their heads with too many leases. ?It?s sort of like college students who sign up for too many credit cards and then find themselves with so many obligations they can?t even pay off their college loans, let alone their credit debt.

    But unlike college kids who are probably charging things they really don?t need and should just find a way to live without them, the challenge for club managers is to find ways to strike a pro per balance of their financing options for all of the equipment that?s needed to run their operations. ?Usually, this comes down to cash flow-related decisions. Here are some of the key factors that, in my experience, have helped me make the best calls on lease- vs.-buy issues:

    • Replacement Costs- When I arrived at my current club, I found that we had lease arrangements set up for all computer printers. While this might make sense for higher-end laser printers, the price of the inkjet printers that are fine for most departments? needs have fallen so low, they?ve also become disposable. ?Why lease these printers, when they can be purchased for a minimal amount of cash?
    • Changing Technology- Equipment that meets your business needs today may be obsolete three years from now. ?Leasing can give you the flexibility to maintain a competitive edge by not only making it easier to start out with today?s best technology, but then also all owing you to upgrade more readily, if the pace of change is such that the equipment soon loses its advantage.
    • Upfront Outlays-Most leases require minimal (if any) down payments, although if you?re with a startup property that hasn?t yet established a credit history, you may find that larger advance costs (or at least an extra month or two?s payments, as deposits) may be involved. ?But generally leases allow you to get immediate use of equipment with minimal upfront costs.
    • Payment Flexibility-The number and variety of payment options that leasing companies now offer make it much easier to find an arrangement that works best for a specific need or budget. ?There are plans for seasonal or ?skip payment? arrangements (good for properties that have significant swings in month-to-month activity); deferred payment plans (which can help hold down costs while you?re ramping up with training and learning how to use new equipment most efficiently and productively); ?step down? and ?step up? programs (to either start out with larger payments and then lower the finance charges over time, or increase payments in step with improved revenues), and many other creative options.
    • Accounting Simplicity-Leasing can eliminate the need for complicated depreciation schedules, because lease payments are generally line-item expenses on your profit and loss statement. ?And, because these payments can often be treated as a pre-tax business expense, you may even reduce your taxes, depending on your club?s status. ?(As always, you should make sure to get your club?s finance and accounting experts involved with each individual lease-vs.-buy decision; this has become even more critical as the options for leasing arrangements have expanded. ?It is also critical to have other sets of expert eyes read the fine print of any leasing contract, to make sure you haven?t missed some hidden traps.)
    • Predictability-Unlike bank lines of credit that usually have variable rates, lease payments are fixed, no matter what happens in the financial markets. ?So if you?re looking to fund equipment over a period when interest rates promise to be volatile, leasing can help lock in some peace of mind. ?Remember the 1980s, when interest rates rose from 9% to over 20% in one year? ?That?s what drove a lot of the growth in the leasing market cited earlier, because no one wanted to go through that again.
    • Cost of Ownership-A variety of tax benefits can often be gained through ?finance to own? leases. ?If your property qualifies (again, this is a call your finance and accounting experts will have to help you make), you may be able to deduct a significant portion of a capital expense in the first year of a lease arrangement. ?Certain types of equipment are especially well-suited to this path to ownership, including golf cars and other vehicles, course aeration, mowing and other maintenance equipment, and other equipment with long ?life expectancies? and an extended projected value to club operations.? (How a lease can qualify to be capitalized in this way is an article in itself-but you should start by becoming familiar with the ?four-point test? that?s involved with the process; if a lease satisfies any one of the four tests, it is automatically classified as a capital lease. ?The tests include Transfer of Ownership; a Bargain Purchase Option (below fair-market value); Lease Terms Above 75% of the Life of the Leased Item; and Greater than 90% Fair- Market Value.)
    • Year-round Efficiency-For properties that acquire equipment at different times throughout the year, leasing can help streamline the process, through Master Lease Lines that can be secured to cover ongoing needs. ?A discounted rate can be earned for all items cove red by the master lease, and there?s only one agreement to sign.
    • Avoiding ?Passing the Hat?-In private clubs, this may be the most compelling factor for taking a longer look at leasing right now. ?Because of what so many clubs are now spending on major renovation projects that are funded through special assessments, it?s certainly not nearly as easy-or advisable-to try to ? tax? membership through capital dues that fund needed equipment acquisitions. ?That often makes leasing more attractive, to help lessen the blow of unexpected expenses, retain more working capital when revenues are low, and keep more cash on hand for future needs.

    Lessor Beware

    If any or all of these factors lead you to a decision to lease, you still, of course, need to be careful as you proceed with the arrangement. ?Beware of early termination charges, term lease costs, and end-of-lease buyout options. ?In addition, if at the end of your lease the equipment shows more wear and tear than normal, you may be subject to additional fees; many new properties that have leased their initial equipment have found this out the hard way, getting hit with substantial extra charges at the end of the lease because of the added wear and tear caused by heavy construction dirt and grime.

    As with all decisions we make as club managers, its best not to be forced by habit or convenience into any specific financing method.? Every property can benefit from using a variety of financing options, so it?s important to stay flexible. ?Yes, it takes more time to look at all of the options-but it can be well worth the effort, to help optimize savings and financial efficiencies for your club.

    The Untold Stories: International law, The M23 Insurgency, and ...

    The M23?s latest assault on Goma has an international legal consequence and constitutes a set of war crimes. The large-scale military assault launched by M23 on Goma, and the manner in which both Rwanda and M23 forces are fighting this war, raise numerous red flags regarding large scale violations of human rights and international humanitarian law (IHL). Such violations have long characterised the international legal framework in armed conflict; yet despite post-Cold War improvements in the enforceability of international criminal law, in the Congo context those who perpetrate human rights violations and war crimes seem largely immune to legal accountability.
    The indictment of the Congo War Lord commonly known as Terminator has proved disastrous and difficult to enforce and the current UN Security Council sanctions against the M23 rebel leader Sultan Makenga is likely to suffer the same fate, yet the Rwandan leaders who have been supporting these conflicts in Congo for almost 2 decades seem not bothered by the continued death of innocent people. The International Community with the largest UN Peace keeping force in the world stationed in Congo, just looked on as the M23 forces matched into Goma without any resistance.
    Certainly, international law offers no panacea for the death and destruction of war; nor does most media coverage of the Congo conflict devote more than the scantiest attention to the human rights implications of such violence. International law does, however, provide the most important standard against which the conduct of opposing sides can be judged. Such judgments have political currency, if not during the heat of battle then later. International human rights campaigner Raji Sourani described it in the midst of the current violence, human rights is the ?skin? to protect civilians from the all-out aggression of those who attack them.
    International law impacts the present war in Congo in two key ways. One pertains to whether the violence deployed by each side complies with or violates IHL, in particular the Geneva Conventions of 1949 and their Additional Protocol I of 1977. The other, more complicated issue pertains to the assistance the Rwandan government is giving the rebel group M23.

    Rwanda under Kagame for his personal economic reasons also advances the novel interpretations of IHL in order to project the legitimacy of dubiously legal or patently unlawful practices in his involvement in Congo by arguing that Congo harbors the former militias who committed genocide in Rwanda in 1994. These principles are: civilian immunity (ie, the prohibition against intentionally targeting civilians or otherwise treating them as combatants); distinction (i.e., the imperative to distinguish between civilians and combatants in military operations, and for combatants to distinguish themselves as such through identifiable dress and insignia and by carrying arms openly); proportionality (ie, the requirement to use force in a manner that is proportionate to the military value of the target); necessity (ie, the obligation to restrict targets or tactics to those necessary to achieve legitimate military goals); and humane treatment (ie, the prohibition of torture, inhumane and degrading treatment of prisoners, and the imperative to guard the rights and interests of ?protected persons?, the legal term for civilians in captured territories)..
    Unfortunately, there has been violation of these entire international legal obligations by the rebels in the territory they have captured. Reports have indicated massive killings, abductions of civilians, rape of women and disappearances. Ultimately, no matter how much Rwanda wants to use Rwanda militias in Congo as the political, legal and moral interference in the Congo affairs, its actions and legacy, are not far from those of other states which systematically use violence against civilians. This will be determined by its adherence to or violations of normative interpretations of international law. The longer Rwanda under Kagame continues to kill Congolese directly or by his rebel proxy M23 indiscriminately and with impunity, and the longer it maintains the military and financial illegal support of this notorious rebel group, the more such policies will face greater de-legitimation and opprobrium.
